EMPLOYEES | MINIMUM WAGE AND OVERTIME PAY

The Fair Labor Standards Act (FLSA) is the federal law that prescribes standards for the basic minimum wage and overtime pay. FLSA applies to most private and public employment positions. It requires employers to pay covered employees who are not otherwise exempt at least the federal minimum wage and overtime pay of one-and-one-half-times the regular rate of pay.

State laws in New York and New Jersey proscribe additional standards for the basic minimum wage and overtime pay. New Jersey and New York law are different with regard to the minimum wage and the definition of overtime hours.
