EMPLOYEES | IMPROPER DEDUCTIONS FROM WAGES

Pursuant to New York law, employers are only permitted to make certain statutory deductions from an employee’s paycheck. If an employer makes deductions for some expense that an employee allegedly caused to his or her employer during the course of his or her employment, the employer may be violating this law.

For example, if an employee is damages a piece of the employer’s equipment in the regular course of employment and the cost of repair is deducted out of his or her paycheck, it is likely that deduction would be improper. Also, deducting for vacation time that was earned pursuant to the employer’s policy may also be considered an improper deduction pursuant to New York Law.
